Terms of Service

Effective Date: September 29, 2026

These Terms of Service ("Terms") govern driving instruction and related services provided by EA Driving Instructor. By booking or participating in a driving lesson, the student and, when applicable, the student's parent or legal guardian agree to these Terms.

1. Driving Instruction Services

EA Driving Instructor provides behind-the-wheel driving instruction and related driver-education services.

Lessons are intended to help students develop safe, responsible, defensive driving habits and prepare for independent driving.

Driving instruction does not guarantee that a student will pass a DMV driving examination or obtain a driver's license.

2. Student Eligibility

Students must possess all permits, licenses, documents, and authorizations required by applicable California law before participating in a driving lesson.

Students must provide accurate information regarding their driving eligibility.

EA Driving Instructor may refuse or discontinue a lesson if the instructor reasonably believes the student cannot legally or safely operate the vehicle.

3. Scheduling

Lessons are subject to instructor availability.

Students should arrive or be ready at the agreed pickup location at the scheduled lesson time. Late arrival may reduce the amount of available instructional time.

EA Driving Instructor may need to change or cancel a lesson because of illness, vehicle problems, unsafe weather or road conditions, emergencies, or other circumstances beyond reasonable control.

4. Cancellations and Rescheduling

Students should provide at least 24 hours' notice when cancelling or rescheduling a lesson.

Late cancellations or missed appointments may be subject to a cancellation fee or forfeiture of the scheduled lesson/payment, except where otherwise agreed or required by law.

EA Driving Instructor may waive a cancellation fee when appropriate because of emergencies or exceptional circumstances.

5. Payments

Lesson prices and payment requirements will be communicated before or when services are booked.

Payment may be required before or at the time of the lesson, depending on the arrangement made with EA Driving Instructor.

Any applicable refund will be handled according to the cancellation terms and applicable law.

6. Student Conduct and Safety

Safety is the highest priority during driving instruction. Students must:

  • Follow reasonable safety instructions given by the instructor.
  • Operate the vehicle responsibly.
  • Avoid using a mobile phone or other distracting device while driving except when legally permitted and specifically authorized.
  • Not participate in a lesson while impaired by alcohol, cannabis, illegal drugs, or any substance or condition that makes driving unsafe.
  • Inform the instructor of any circumstance that may affect their legal ability to drive safely.

7. Vehicle Safety

Vehicles used for instruction should be operated according to the instructor's directions and applicable traffic laws.

Students may be financially responsible to the extent permitted by applicable law for damage resulting from intentional misconduct or other circumstances for which the student is legally responsible.

8. Assumption of Ordinary Driving Risks

Driving involves inherent risks, including traffic conditions, actions of other road users, weather, and unexpected roadway hazards.

Students are expected to follow the instructor's directions and applicable traffic laws.

Nothing in these Terms is intended to waive rights or responsibilities that cannot legally be waived under California law.

9. No Guarantee of DMV Test Results

EA Driving Instructor cannot guarantee that a student will pass a written or behind-the-wheel DMV examination.

DMV licensing decisions are made by the appropriate government agency. Student performance, preparation, compliance with applicable requirements, and testing conditions can affect the outcome.

10. Minors

Students under 18 must satisfy applicable California requirements for minors learning to drive.

A parent or legal guardian may be required to authorize services, provide necessary information, and agree to applicable policies on behalf of the minor.

11. Personal Belongings

Students are responsible for their personal belongings. EA Driving Instructor is not responsible for items left in a vehicle except to the extent responsibility is imposed by applicable law.

12. Website Information

We make reasonable efforts to keep information on our website accurate and current. Prices, availability, policies, and services may change.

If website information conflicts with a written agreement specifically entered into between EA Driving Instructor and a customer, the written agreement will control to the extent permitted by law.

13. Privacy

Use of personal information is governed by the EA Driving Instructor Privacy Policy.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where federal or other applicable law controls.

15. Changes to These Terms

EA Driving Instructor may update these Terms periodically. Updated Terms will be posted on the website with a revised effective date.
